Albuquerque, NM (March 14, 2023) — One person was killed late Friday night after being struck in a hit-and-run accident. The crash happened in Albuquerque’s International District on Zuni Road SE, around one block south of Route 66.

According to Albuquerque Police Department spokesman Gilbert Gallegos, an unidentified pedestrian was walking in the middle of the road when a sedan driving westbound hit them. First responders found the pedestrian with serious injuries and transported them to the hospital, where they later died.

The APD Motors Unit is investigating the crash. So far, they have not been able to locate the driver. They also haven’t determined which direction the pedestrian was walking when they were struck.

Rights of Hit-and-Run Victims and Their Families

When it comes to hit-and-run accidents, the legal options available depend on the circumstances of the accident. If the victim dies as a result of the crash, families may be able to file a wrongful death claim if the driver is found. However, this could take weeks, months, or even years. It all depends on whether the investigation by the police is successful.

If officials locate the driver, certain family members may pursue damages for the loss of their loved one, including but not limited to:

  • Funeral and burial expenses,
  • Medical bills of the deceased before death,
  • Loss of companionship,
  • Loss of financial support,
  • Loss of consortium, and
  • Mental anguish.

Keep in mind that there are other damages that may apply depending on the situation. For example, it may be possible to also pursue compensation for the pain and suffering the victim experienced before death. To be sure, it’s best to speak with an experienced personal injury attorney.

Who May File for Wrongful Death

In New Mexico, the personal representative of the pedestrian killed files the claim. Typically, this is a spouse, child, or parent. However, no matter who files the claim, the damages in the case go to surviving family members in a specific order, which is defined in NM Statutes § 41-2-3.
